Sufism and Psychoanalysis have the potential to create a synergy of Eastern spiritual traditions and Western psychological frameworks. This paper examines the similarities and differences between Sufism and psychoanalytic self-psychology, particularly of Heinz Kohut, and emphasizes the mutual appreciation of psychoanalytical self-psychology approaches and patients’ religious beliefs, demonstrating that they are not in opposition and can work in harmony. The data was collected through literature reviews and documentation study. The results reveal that Sufi practices such as dhikr (remembrance of God) (...) and spiritual guidance from a sheik are equally self-psychological concepts, equipped with empathy and self-object transference, capable of producing a more complete and culturally sensitive therapeutic encounter. It was also revealed that such a mental health environment can be created in which the spiritual and cultural dimensions of diverse patient populations can be recognized. A blend of Sufi and psychoanalytical values can lead to innovative, culturally sensitive, and effective mental health interventions to enhance the understanding of the spiritual heritage of Islam and address individuals' psychological and spiritual needs. This study’s implications lie in the fact that it encourages concerns of cross-cultural psychoanalysis by providing a blending platform to understand Islamic spirituality as well as western psychological theories and practices. Future studies may further explore the role of such a cross-cultural psychoanalysis to understand various healthcare practices across inter-disciplinary faiths and communities. (shrink)

Aims To examine the understanding of the ethical dilemmas associated with Big Data and artificial intelligence (AI) among Jordanian medical students, physicians in training, and senior practitioners. Methods We implemented a literature-validated questionnaire to examine the knowledge, attitudes, and practices of the target population during the period between April and August 2023. Themes of ethical debate included privacy breaches, consent, ownership, augmented biases, epistemology, and accountability. Participants’ responses were showcased using descriptive statistics and compared between groups using t-test or ANOVA. (...) Results We included 466 participants. The greater majority of respondents were interns and residents (50.2%), followed by medical students (38.0%). Most participants were affiliated with university institutions (62.4%). In terms of privacy, participants acknowledged that Big Data and AI were susceptible to privacy breaches (39.3%); however, 59.0% found such breaches justifiable under certain conditions. For ethical debacles involving informed consent, 41.6% and 44.6% were aware that obtaining informed consent posed an ethical limitation in Big Data and AI applications and denounced the concept of “broad consent”, respectively. In terms of ownership, 49.6% acknowledged that data cannot be owned yet accepted that institutions could hold a quasi-control of such data (59.0%). Less than 50% of participants were aware of Big Data and AI’s abilities to augment or create new biases in healthcare. Furthermore, participants agreed that researchers, institutions, and legislative bodies were responsible for ensuring the ethical implementation of Big Data and AI. Finally, while demonstrating limited experience with using such technology, participants generally had positive views of the role of Big Data and AI in complementing healthcare. Conclusion Jordanian medical students, physicians in training and senior practitioners have limited awareness of the ethical risks associated with Big Data and AI. Institutions are responsible for raising awareness, especially with the upsurge of such technology. (shrink)

BackgroundPsychological distress/morbidity is amongst the primary reason for the cause of pain at multiple sites, its progression, and recovery. Though still not very clear if physical pain in the neck or the back may predict psychological morbidities or not. Thus, we investigated the association between combined neck or back pain and psychological distress/morbidity.MethodsA cross-sectional study was conducted in Al-Kharj, Saudi Arabia, including 1,003 individuals. The questionnaire comprised of General Health Questionnaire-12 and some questions about neck and back pain. Data analysis (...) was done using statistical software SPSS version 26.0.ResultsThe results of the multivariate analysis revealed a significant positive association between neck/back pain status and total GHQ score. Having neck/back pain had almost a 2.5 times greater risk of psychological distress/morbidity. Further, females were more likely to have a higher risk of psychological distress/morbidity than males while adjusting for sociodemographic and clinical characteristics.ConclusionThe combination of neck and back pain was significantly associated with the Saudi population’s psychological problems. Therefore, the Saudi government needs to devise high-risk strategies and allocate adequate resources to the cause so that at-risk people can be shielded from the adverse complications arising from this condition in the long run. This paper relies on primary resources dealing with the history of Oman along with British documents, which are the most important materials that dealt with the situation in the region, in general, and in Oman in Particular, at a time when Britain had power, presence and military control over India through the Government of British India. At that time, Britain tried to open lines of communication and forge agreements with the Arabian Gulf countries in order to secure its control over (...) this vital region and secure communications with its colonies in India. This study focuses on the economic and commercial relations between the two countries including trade of spices, textile, weapons, slaves, dates and other goods, the currencies used in these commercial exchanges, and the volume of trade. It also explores the volatility of these relations in different periods. The study also examines the social and cultural relations, mutual migrations, and military and political ties. In addition, it explores various aspects of reciprocal influence between the two areas in different periods and during turbulent times for the sultanate of Oman and the region, prior to, during and after the First World War. It investigates these relations from signing of the treaty of AL-Seeb in 1920 and the stabilization phase it created up to the end of the study period. The study has reached a number of conclusions about the development of these relations and the factors influencing this development at a time when sultan Timor tried to maintain independence in running the country despite the British influence. It also focuses on how the sultan attempted to benefit from Britain’s need to secure shipping lines by enhancing the sultanate’s trade with India until India became the first economic and trade partner with the sultanate during this period. The sultan tried to maintain a friendly relationship with Britain and India, where his currency was mined and where he used to stay for recuperation. (shrink)

Starting from macroscopic and microscopic facts of cerebellar histology, we propose a new functional interpretation that may elucidate the role of the cerebellum in movement control. The idea is that the cerebellum is a large collection of individual lines (Eccles's : Eccles et al. 1967a) that respond specifically to certain sequences of events in the input and in turn produce sequences of signals in the output. We believe that the sequence-in/sequence-out mode of operation is as typical for the cerebellar cortex (...) as the transformation of sets into sets of active neurons is typical for the cerebral cortex, and that both the histological differences between the two and their reciprocal functional interactions become understandable in the light of this dichotomy. The response of Purkinje cells to sequences of stimuli in the mossy fiber system was shown experimentally by Heck on surviving slices of rat and guinea pig cerebellum. Sequential activation of a row of eleven stimulating electrodes in the granular layer, imitating a of the stimuli along the folium, produces a powerful volley in the parallel fibers that strongly excites Purkinje cells, as evidenced by intracellular recording. The volley, or has maximal amplitude when the stimulus moves toward the recording site at the speed of conduction in parallel fibers, and much smaller amplitudes for lower or higher The succession of stimuli has no effect when they in the opposite direction. Synchronous activation of the stimulus electrodes also had hardly any effect. We believe that the sequences of mossy fiber activation that normally produce this effect in the intact cerebellum are a combination of motor planning relayed to the cerebellum by the cerebral cortex, and information about ongoing movement, reaching the cerebellum from the spinal cord. The output elicited by the specific sequence to which a is tuned may well be a succession of well timed inhibitory volleys the motor sequences so as to adapt them to the complicated requirements of the physics of a multijointed system. The Umayyads (41-132/661-750) were the first Muslim dynastic state established in Damascus after the Rasheedun Caliphs. The Umayyads' transformation of the caliphate into a sultanate, their tribalist and discriminatory approaches, as well as the exaggerated palace life and entertainment of some caliphs have been the subject of criticism. Among the Umayyad caliphs, Yazīd II (101-105/720-724) was remembered for his drinking parties and love affairs with his concubines, and his fondness for entertainment to the degree of debauchery was described. The night (...) life of the caliph in question with his concubines named Sallāma and Habābah and his inclusion of them in the administration did not escape attention.It is known that the Umayyads had some problems in their relations with the new non-Arab Muslims (mawālī). Yazīd II’s elder brother, al-Maslama İbn ʽAbd al-Malik, was prevented on the grounds that his mother was a mawāli, although he was known to be the most worthy candidate for the caliphate among his brothers. Yazīd II, on the other hand, was appointed as the heir apparent with the advantage of being a member of the dynasty on his mother's side and then he was brought to the caliphate.After ‘Umar ibn ʽAbd al-ʽAziz, who was recognised as the ‘Fifth Rasheedun Caliph’ thanks to his piety and effective administrative skills, Yazīd II, who had a completely opposite character and administrative understanding, was brought to the caliphate. Although he imitated ‘Umar ibn ʽAbd al-ʽAziz in the first days of his caliphate, this situation did not last long. Soon after, he came under the influence of his favourites named Sallāma and Habāba and started to govern the state under the influence of these two names. It has also been stated that he jeopardised the future of the state and the dynasty with his arbitrary practices and debauched life. The sources give limited information about the lives of Sallāma and Habābah. Sallāma was born in Mecca as the child of a family whose parents were slaves (muwellada). It is narrated that she memorised almost all poetry and song lyrics from the Jahiliyyah period until the time she lived, and that she was extremely knowledgeable in the al-Qur’ân al-Karîm, hadiths and religious sciences. But with her mesmerising voice and physical beauty, she became famous as a singing courtesan. She gained her real fame when she met Yazid ibn ʽAbd al-Malik and became a part of the palace life. After Yazid II became the caliph, she rose in the palace and started to have a say in the state administration. It has been stated that Habābah was not inferior to Sallāma with her physical beauty, superior performance in singing, knowledge and manners, and even more advanced. As a matter of fact, Yazīd II was enamoured of her at first sight and wanted her very much, but his brother Caliph Sulaymān prevented him. Henceforth Yazīd II seated these two combines on his right and left in his palace and did not leave them until his death.Sallāma was an extremely intelligent, knowledgeable and beautiful woman who could be called Yazīd II’s first love. She almost ruled the state by using the affection and trust that the caliph cherished for her. So much so that the highest bureaucrats of the state could only be appointed with her approval. With her beauty, voice, and sharp intelligence, Habābah also enchanted the caliph, and her intervention in the state administration cost the caliph his life. Yazīd II was very saddened by the sudden death of Habābah during an entertainment party. His body was kept waiting for days and could only be buried after the warning of the caliph’s elder brother al-Maslama. The caliph, who knew the cause of her death from himself, never left her grave day or night. Weeks after the burial, he had her grave opened, embraced and kissed her decomposed corpse, lamented, and it was recorded that he died of grief. This situation, which cost the caliph his life, was expressed as ‘lovesickness’.This information and details are mentioned in Islamic historical sources. In this study, by using classical (Arabic) sources, two of the women who we think were influential on politics are introduced. Thus, we have contributed to the discussions on the presence and role of women in state administration in an early period of Islamic history. In this study, the portraits of two women, Habāba and Sallāma, who we think were involved in politics during the Umayyad period, albeit limited to the reign of Yazīd II, are given. While their short biographies are discussed, the status of women in the Umayyads, palace life and entertainments are touched upon. Again, the concepts of concubine and qayna (singing concubine) and umm al-walad, which express their art and social status in the person of these two concubines are explained. (shrink)

Background: The prevalence of diabetes is rising worldwide, especially in poorer nations. It is anticipated to emerge as the sixth main cause of mortality globally by 2030. The factors linked to self-awareness in diabetes patients are still debated.Aim: To identify factors associated with self-awareness among diabetic patients attending Al-Zaher primary health care center (PHCC), Makkah Almukaramah City, Saudi Arabia 2024Methods: A cross-sectional study was performed using a randomized sample of diabetes patients visiting Al-Zaher Primary Health Care Center in Makkah AlMukarramah (...) city. The used questionnaire included demographic information and data on the patient's beliefs and attitudes toward diabetes mellitus (DM). The statistical analysis was conducted using SPSS. A P-value below 0.05 was deemed significant.Results: The study included 523 patients with T2DM in different genders, age categories from 20 to 70 years and education levels. The majority of respondents were married (79.3%). 53.5% of respondents were fully informed of their health conditions, however 52% were not confident in managing their diabetes. 60% of patients stated that regular diabetic follow-up every one to two months would assist in maintaining their health. 50.7% of respondents said there is a significant likelihood of getting diabetic issues in the future. While 50.9% of respondents felt that diabetes may be remedied with medicine, 47% of them thought that those with diabetes would have a shorter lifespan compared to those without the condition. 48% of patients selected meals optimal for their health, whereas 51.6% engaged in exercise at least three times weekly to enhance blood glucose regulation. Nonetheless, 51.1% of them sometimes missed doses of diabetic medicine. The average total score of patients' self-awareness about diabetes mellitus was 6.8±3.9, with a median of 8 (range 1-13).Conclusion: The study found inadequate self- awareness among diabetic patients. Male gender, younger age and high education level are the significant factors associated with high self-awareness toward DM. The study highlights the need for educational programs to improve self-awareness and empower patients, especially females, older individuals, and those with lower education levels, in Saudi Arabia. Purpose Moor designated two major problem sources typifying the social and ethical implications of computer technologies, namely, “policy vacuum” and “conceptual muddles.” Motivated by Moor’s seminal definition and Floridi’s conceptualization of information and communication technologies as re-ontologizing technologies, this study aims to explore Omani undergraduates’ cognition regarding ICT ethics. Design/methodology/approach Adopting a grounded theory approach for the constant comparative thematic analysis, the constituents of ICT ethics-related cognition among undergraduates and influencing factors were scrutinized. Qualitative data were gathered via focus group (...) discussions with undergraduates and interviews with academics and information systems professionals at Sultan Qaboos University. Findings In total, 10 thematic categories revolving around a core category, constructing conceptual perceptions of and attitudes toward the realms constituting ICT ethics using an ontological, object-oriented approach, emerged from the comparative analysis. Undergraduates were found to adopt an applied approach when defining professional ICT ethics codes and policies, with a particular focus on information privacy and integrity. Research limitations/implications This qualitative study was conducted at a single research site. This may restrict the generalizability of the findings. Postgraduates were not considered when designing this qualitative inquiry. Originality/value The findings of the study hold theoretical and methodological significance with regard to ICT ethics-related cognition in the era following the fourth industrial revolution by sustaining feminist ethics in this research. “Suu ulimwengu bahari tesi [This world is a tempestuous sea],” laments the poet Sayyid Abdallah bin Ali bin Nasir in his poem Al-Inkishafi, in which he seeks a stable point in the stormy ocean of historical upheavals. Al-Inkishafi has been translated as “The Soul’s Awakening”, as self-examination or revelation. Against the backdrop of a depiction of the economic decline of the Pate sultanate at the end of the seventeenth century, the poem dwells on the vanity of earthly life and worldly (...) pleasures and questions the presence of the self in the world and whether the self can withdraw itself from the world in search of a transcendent stable point. The poem arose in the context of an ongoing poetic discourse along the East African coast, where Sufism and religious asceticism found expression in poetry, and my paper reads it alongside other poems from this period as evidence of the constitution of introspection, interiority, and a new kind of self-consciousness. I will specifically examine the role of attention in this process. In addition to being a cognitive filter that removes confusion and error from thought and ensures the self—a relational construct arising from the interaction of reason, passions, and the world—constructs an adequate intellectual representation of the world, attention acquires ethical and pragmatic connotations in facilitating the self’s resistance to temptation as well as its focus on salvation. It is, effectively, only thanks to attention that the self is able to discriminate both cognitively and morally and, crucially, to maintain agency through exercising control over its desires and actions. Yûsuf b. Hussein al-Kirmāstī (d. 900/1494), a figure who lived in the 15th century, studied under scholars of his time such as Khujazāda Muṣliḥuddīn Efendi (d. 893/1488). Kirmāstī was from the district of Kirmāstī (Mustafakemalpaşa) in Bursa. Yûsuf b. Hussein al-Kirmāstī was a qadi (judge) during the reign of Sultan Bâyezid II (1481-1512). Kirmāstī, originally from Kirmāstī (Mustafakemalpaşa), Bursa, established a medrese (theological school) in Istanbul named Kirmâstî. After serving as a lecturer in various madrasahs, he transitioned to the (...) judicial field, carrying out qadi duties in Bursa and Istanbul. His just decisions and courageous stance during his tenure as a qadi earned him the appreciation of Sultan Bâyezid II. Kirmāstī, who had a mosque, a madrasah, and a school in Istanbul, is known to have had an additional school in his hometown of Kirmāstī. He passed away in 900/1494 and was buried next to the school he built in Fatih Mosque. This study aims to reintroduce Kirmāstī to the contemporary academic world from a fresh perspective, considering his proficiency in religious and linguistic sciences of the time, including rhetoric, badiʿ, bayān, uṣūl, fiqh, debate and ʿaqāid. The focus is on this study the stylistic elements of literary technique styles (al-muḥassināt al-maʿnewiyyah) within his specific work titled “al-Mukhtār fi-l-maʿānī wa-l-bayān”. Through this exploration, the significant Ottoman scholar and his works are presented, followed by an analysis of the literary technique styles in “al-Mukhtār fi-l-maʿānī wa-l-bayān” bringing attention to interested parties. : Mu1ammad Taqiyy al-Dīn al-Maqrīzī is undoubtedly the historian with the most expansive repertoire of the entire fifteenth century Arabic historiography. His al-Mawā’iẓ wa-l-i’tibār bi-dhikr al-khiṭaṭ wa-l-āthār, in particular, is a unique achievement, which manages to present a general historical discourse through the chronicling of buildings and topography. This unprecedented book, this paper argues, may have benefited from the author’s extended association with Ibn Khaldūn, the great interpreter of the notion of ’umrān. Ibn Khaldūn was al-Maqrīzī’s revered teacher for at (...) least thirty years. He seems to have influenced his pupil’s thinking about the city as the domain of civilization in two ways: analytical, that is to look for causes and effects behind events and appearances, and interpretive, that is to see in the urban and architectural history of the city the illustration of the underlying civilizational cycle. In the Khiṭaṭ, al-Maqrīzī seems to have applied his master’s theory to a concrete example – the city of Cairo – and drew from it pronounced moral lessons on the decline he was observing in the Mamlūk sultanate. This is probably why the Khiṭaṭ’s influence has endured for more than five centuries: a tribute to its author’s ardent passion and filial affinity with his city and country, as well as his interpretive framework, which he probably absorbed from Ibn Khaldūn. Chelebi (Çelebi) Sulṭān is a Ṣūfī poet. Due to poor and limited sources, there is a hardness in finding accurate and sufficient information about him. Abdülbaki Gölpınarlı claimed that this anonymous poet could be Oğlan Sheikh İsmāʿil-i Maʿşūḳī (d. 1539) from Bayramī-Melāmī by relying on the unanimous ghazal recorded in Ḥālet Efendi 800 in Suleymaniye Library. However, the fact that the aforementioned ghazal with simple copy variations published in Eşrefoğlu Rūmī Diwan weakens the credibility of his argument that Chelebi Sulṭān (...) could be Oğlan Sheikh İsmāʿil-i Maʿşūḳī. Though the acknowledgment of this data, Gölpınarlı still insisted on the credibility of his claim that the ghazal belongs to Oğlan Sheikh. Moreover he argued that the claims suggesting that the ghazal belongs to Eşrefoğlu Rūmī (d. 1469) should be questioned. Other than this ghazal, there is one more qasida (ḳasīde) with having gizlidir word after the rhyme associate to Chelebi Sulṭān, and an annotation to this qasida by Āyīne-zāde Meḥmed Şemseddīn-i Sirozī (d. 1688/89). However, neither the qasida and ghazal attributed Chelebi Sulṭān nor the Āyīne-zāde’s annotation provide satisfying information to identify the identity of the poet. Therefore, it can be claimed that Chelebi Sulṭān’s identification is based on weak arguments. No more evidence can develop these estimations into evidence-based arguments. This article tries to provide a virtual framework for the identity of Chelebi Sulṭān. In this context, the article firstly discusses Chelebi Sulṭān’s disposition and popularity on Ṣūfī groups by considering the contents of the manuscripts mentioning him. Then, it analyzes whether Chelebi Sulṭān is associated with Ḥurūfīs or not by focusing on the ism-musemmā subject in the two first couplets of the qasida attributed to the Ṣūfī poet. Finally, the article speculates whether the poet called Chelebi Sulṭān in literature could be Misālī (d. 1577), or not, who is one of the Ḥurūfī poets. The subject of Chelebi Sulṭān's connection with Ḥurūfīsm is examined under two titles in the article. The possibility of Chelebi Sulṭān to be Misālī, one of the Ḥurūfī poets, was discussed based on the qasida with nedür rhyme. In this regard, there are two assumptions. The first one is that the pseudonym Misālī is mentioned in the qasida, and the second evidence is that there is a qasida with nedür word after rhyme belonging to Chelebi Sulṭān in the two copies of the Misālī Diwan. However, although the mentioned qasida exists in the recent copies, this qasida is not found in the oldest copies of the diwan. Therefore it is possible to conclude that this lack weakens the possibility that Chelebi Sulṭān could be Misālī, one of the Ḥurūfī poets. The second title is related to the issue of the ism-musemmā in the first two couplets of the qasida with nedür word after rhyme. Through this analysis, it was discussed whether Chelebi Sulṭān could be Ḥurūfī or not. At this point, it is revealed that there is a similarity between the two couplets of Chelebi Sulṭān in the qasida with nedür word after rhyme on the issue of ism-musemmā and some other couplets of Ḥurūfī poets (Nesīmī / Ḫalîlî, Misālī, et al.) on the same issue. Besides, the views of a few groups, apart from the Ḥurūfī Poets, that discussed ism-musemmā issue in their poetry, were evaluated. The article refers to the Ṣūfī poet's qasida with nedür word after rhyme while discussing the issue of which groups favored Chelebi Sulṭān more and it also tried to determine which groups read this qasida at that period. To discuss the general content of the manuscript, the manuscript registered in Suleymaniye Library Mihrisah Sultan number 185, the corpus cataloged in Suleymaniye Library, Galata Mevlevihanesi 233, and the manuscript cataloged in Millet Library Ali Emiri Collection (AEArb) 4341, were examined. Thus it can be claimed both Chelebi Sulṭān and his qasida were popular among heterodox groups, as it was observed that the qasida also exists in the works of Ḥurūfī, Alevi-Bektashi, and Bayramī-Melāmī groups. Despite all this, there is no clear conclusion regarding the identity of Chelebi Sulṭān. Nevertheless, it is possible to say that Chelebi Sulṭān was popular among heterodox Ṣūfī groups and that some Ḥurūfī views influenced him. (shrink)

Court (Shar’iyya) recordings are at the forefront of primary written sources, which contain important documents related to Turkish history, sociology and culture. The court records shed light on city history of the period concerned with rich information and documents. These records are important books in which the documents related to the judicial, administrative, economic, architectural and social structure of a city as well as diplomatic correspondence between the center and the province were recorded. The purpose of this study is to (...) prepare a detailed catalog in addition to the catalog which was made in 1963 and contained only 119 books specifying only the dates covered by the book number. As we have seen in this study, all of the 119 notebooks in the records do not consist of the court registers in the known form. They are the books that include the records of court proceedings, which are different from those of the court, especially after the Tanzimat e.g. Qassam, Enkiha, Zabt al-Da’wa, Permission and so on. The microfilms of the books were presented to the service of researchers in Sivas Ziya Bey Library of Ancient Works. The originals of the books are in the Prime Ministry State Archives.SummaryShar’iyyaregisters are one of the primary written sources about Turkish history, sociology, and culture relevant to our life. They are important notebooks, which are related to the judicial, administrative, economic, architectural and social structure of a city, and also in the form of diplomatic correspondence between the central and provincial posts.After the Anatolian Selçuk (Saljūq) State, which collapsed under the pressure and domination of the Iranian Mongols in the last half of the XIIIth century, a state was established in the Selçuk-Byzantine border in the north-west of Anatolia in XIVth century, which did not even lasted a hundred years and had a reign in three continents. In the Bursa inscription, which dated to 1337/8, the second Ottoman Sultan (Sulṭān) Orhan was titled as the mujahedeen (warrior), the sultan of the veterans, son of veteran of veteran. The fact that Orhan carring these titles shows that since the earliest times, the Ottoman sultans considered themselves as the leader of the religious war against the infidels. Since the first years of the establishment of the Ottoman State, the Sharīʿa ruled on the establishment of administration and for this reason, they established institution of the Shaykh al-Islām(the chief juristconsult). Firstly, by appointing a subaşı(subashi, an Ottoman gubernatorial title) to the conquered places, then it gradually began to establish judicial courts from the smallest areas.In the XVth century, the number of qāḍī increased in parallel with the increase in their jurisdiction as a result of the expansion of the Ottoman Empire, and the proliferation of the administrative units called sancak, (sanjaq, division of a province) and so the failure of oneqāḍīto satisfy court affairs of an entire sanjaq. New districts arose from some of the former large districts. As a result of this in the XVIth century, the administrative system of the sanjaq's Tımar system and at the same time a geographical integrity of the districts/provinces to see the legal work of a qāḍī to pass by the districts and sub-district as a legal caused to occur two legal definitions that is legal and military administrative. Records of qāḍīs, which is called as sicilemerged because it was their duty to record their works and orders issued to them and the answers and the provisions given to them.The courts of Shar’iyyaserved as primary general courts (maḥākim-i ʿumūmiye) until the declaration of the Tanẓīmāt in the Ottoman Empire and heard the suit at legal, criminal, administrative, military, financial and all kinds of cases. Tanẓīmāt period, or rather Maḥmūd II and the period following him, the judicial organs in terms of reorganization was a circuit that was on the scene.In this way, which was occurred in the judicial system, records which were kept in the Meşihat (Mashīkhat) began to diversify depending on this change. Since in the registry books, which we call classical, all correspondence between the central and provincial offices were recorded. Records such as pleas, letters of patent, verdicts, order of the high, bonds etc. could be found in these documents.These records, which are one of the most important sources of an Ottoman city history, were kept in the museums and libraries of the cities until recently. A few years ago, these records, with a correct decision, were collected in the Prime Ministry Ottoman Archives and it was preserved and presented to the use of researchers by transferring them into digital. The Sivas Court building as it is known in history is now in the Pāshābeg quarter and known as the Court Bazaar in these days. There is no clear information about when the court was built in Sivas. In time, changes have occurred in cities and we are losing the historical side of them. In addition, the fact that people acted in an unconscious manner that would harm the historical texture was the biggest factor in disappearance of material remains. With the remaining physical materials available, we can only access crumb information and we can only make predictions. In this evaluation, the biggest materials are the documents and notebooks, which are the memory of city dates. However, it is understood from the records that there is a foundation belonging to this court and some of the court's repair and maintenance works were carried out by this foundation. As it is understood from a document dated 14 August 1798, one of the repairs was sponsored by Ḥüseyin Efendī. In an inscription dated 1906, which was found during the renovation of the basement of an apartment building owned by the General Directorate of Foundations in May 2018, the location of the building was previously known as the Sivas Muftī 's Office.In this study, a total of 240 registry books belonging to Sivas were prepared as in a catalog system. In this study, we have seen that a great deal of records have been lost, burnt or destroyed in a certain way through history. The burn marks in the records of 79 is a striking example in this regard. The book number 139, which is not shown in Osman Ersoy's work, is a record book in classical form. An important case in this study is that the register number 206, which is registered to Sivas, belongs to the province of Burdur and it is also a registry book in classical form. This study focuses on the praise poem that Ibn Al_Jiyab Al_Gharnati tackled in his poetry. Al_Gharnati was a poet ( laureate), a writer, a minister, and the head of the undersecretary office ( Diwan Al_Kuttab) in Granada for many years. Moreover, he was in a strong relation with four Sultans of Banu Al_Ahmar. The study often examines the image of praise in Ibn Al_ Jiyab's poetry who devoted his poetry collection or poetic project to praise poetry whether praising the (...) class='Hi'>Sultan of Banu Al_Ahmar, the ministers or some notables and companions. The study tries to answer some questions by analyzing the image of the praiseworthy in Ibn Al_Jiyab's poetry: What is the role of the poet who was close to the Sultan in the Grandian era? How did the poets portray the people in power at that time? Did stylistic changes take place in the praise poem or were new meanings introduced that were not preceded by poets before? was the poem a continuation of the praise poem in previous ages? Above all, why later ages were full of praise poems ( odes of praise)? The interest in studying the Andalusian literature and analysing its texts is an artistic and historical necessity. It is an artistic necessity to understand the literary influence, taste and the development of the concept of poetry and the Andalusian's view of it. The Rasūlid chronicles of the reign of al-Manṣūr Nūr al-Dīn ʿUmar b. ʿAlī b. Rasūl depict its first ruler as steadily consolidating the political foundation of the sultanate. Most of these reports clearly portray the dominance of the sultan in Yemen during this period. But a few reveal the limitations of his power in a more complex political landscape, such as an aborted military campaign against a local tribe, an insurrection by a Zaydi sharīf, and the sultan’s assassination (...) by his own military. These specific narratives of opposition to the sultan, however, progressively change over the course of their production from the late 13th century until the first half of the 15th century, as the strength of the sultanate initially peaks and then slowly declines. As a result, the ambiguity of al-Manṣūr ʿUmar’s authority in these narratives is largely reduced, and the historical memory of the sovereignty of the emergent Rasūlid sultanate solidifies in increasingly ideological ways. Recovering a marginal body of pluralist political thought from early twentieth-century India, this article explores how the question of popular sovereignty shaped the federalist reconfiguration of the anticolonial democratic project. The turn to federalism was facilitated by the Indian reckoning with Hegel in the late nineteenth century, which led to the diagnosis that the universality ascribed to monist sovereignty relies on a “unilinear” theory of development. Through a sustained engagement with British pluralist and American progressive thought, Indian federalist thinkers eventually (...) developed a many-willed conception of the people. In so doing, they hoped to overcome the denial of Indian peoplehood on the ground of its lack of national unity and historical backwardness. However, the alternative source of sovereignty the federalists pointed to—plural and many-willed—stood in tension with their simultaneous pursuit of a people speaking in one voice. In this way, the constitutive tension of the pluralist conception of sovereignty came strikingly alive in the colonial world. (shrink)

The concubines, with whom the sultans lived a family life, were classified according to a certain hierarchy in the Harem. The first wives of the sultan and those who gave birth were called Kadınefendi. The other wives with a lower status than the Kadınefendi wives were called Ikbal Hanımefendi. According to Islamic law, marriage with a concubine is not like a marriage with a free woman. If a marriage is desired, the concubine must be freed. Until the 19th century, (...) sultans did not marry their concubines for a few exceptions. In the 19th century, the legal status of concubines in the Ottoman Empire became controversial. The countries of origine changed when the Ottoman Empire was unable to conquer new territory. Consequently, the enslavement procedure of prisoners of war disappeared. Instead, Caucasian immigrants, who had to leave their homeland mainly due to the Russian attacks, gave their daughters to the Ottoman palace so that they would not suffer misery and could reach important positions in the future. Among these were orphans from poor families as well as those from noble Caucasian dynasties. Even though the young women in the palace were called concubines, at least some of them were free/Muslim persons. This meant, that they could not be enslaved according to Islamic law. Although there was no problem for those who served in the palace, a remarkable situation emerged for the would-be spouses of the sultan. Could a woman from a free and Muslim family be the sultan's wife without a marriage bond? Was the limitation of the Kadınefendi numbers to four (in times of Sultan Abdülaziz) due to the Islamic law principle, that a man could marry maximum four wives? Was there a marriage ceremony (nikāh) for Kadınefendi wives? What was the situation of the Ikbal? Satisfactory answers to these questions have not been given yet. However, there are no official records it was claimed that lately sultans married especially their concubines who were Abkhaz descendants and included them among their wives in this way, because they were free and Muslims. Thus, the matter whether Sultan Abdülhamid II's wives were concubines or wedded became the subject of some research today. Memoires claim that almost all of Sultan Abdülhamid's wives were free and of Muslim origin. According to this, it was said that the wives of Sultan Abdülhamid could not have the status of the concubine and that their relationship should have been by marriage. On the other hand, considering that a maximum of four women can be married according to Islamic law, the marriage of the Sultan, who had thirteen wives, raised juristic questions. This problem was most clearly seen in the inheritance case filed by his heirs after the death of Sultan Abdülhamid. In this case, where it was claimed that Sultan Abdülhamid was married to nine wives, no objection was made to that claim. In this study, information about the wives of Sultan Abdülhamid and their legal status was tried to be determined through the documents related to their salaries during the 2nd Constitutional Era. Besides, the issue of nine wedded women, which emerged in the case of Sultan Abdülhamid's inheritance, was evaluated in terms of fiqh (Islamic jurisprudence). Sultan Abdülhamid was never accused of marriages contrary to Islamic law by his opponents during and after his reign. From this point of view, it can be said that there was no situation contrary to Islamic law regarding the Sultan's harem at that time. This might be due to three possibilities: Firstly, some wives have concealed the truth in the court, which is the weakest possibility according to the data obtained. Secondly, the talaq (divorcement) was hidden by Sultan Abdülhamid and his wives were not aware of it. This possibility has been found to be problematic when evaluated in terms of Hanafi fiqh. Thirdly, the practice of al-nikāh al-tanazzuhī (marriage performed in order to avoid from fornication). Considering the correspondence between the state departments in the period starting with the 2nd Constitutional Monarchy and until the Republic, it is clear that the Kadınefendis were regarded as married wives (their number was limited to four), while the Ikbals were regarded as concubines. From this point of view, it is thought that the most plausible possibility is that the Ikbals were regarded as concubines and their marriages were al-nikāh al-tanazzuhī. (shrink)

Abū Ishāq al-Ṣaffār was one of scholars of the Western Qarakhānids’ period who followed the Kalām thought of al-Māturīdī (d. 333/944). His theological works Talkhīs al-adilla and Risāla fī al-kalām, his method in kalām, and frequent reference to his works by Ottoman and Arab scholars indicate that al-Ṣaffār is a respected and authorative Māturīdī theologian. The article focuses on his defense of the kalām. By adding a long introduction to Talkhīs about the naming, importance, and religious legitimacy of the science (...) of kalām, Saffār asserted that the kalām should be learned. When systematical vindication of the science of kalām is examined, it is understood that al-Ṣaffār is the first theologian who reserved a private and voluminous part for defensing the kalām among Ḥanafī-Māturīdīs. Even though he does not state its systematic, it can be understood that vindication of kalām in al-Ṣaffār divides into three parts as of explanation, demonstration and refutation. Al-Ṣaffār’s defending the science of kalām shows that there were opposite thoughts against kalām in the 4th/10th and 5th/11th centuries throughout in Transoxania. In this period Aṣḥāb al-Ḥadīth and Ikhwān al-Ṣafāʾ were the opposite fronts of kalām. In addition, he was trying to go beyond the oppositions of Ḥanafī jurists. His vindication is consistent and has scholarly depth because it is able to be against a strong opposition. -/- SUMMARY: Abū Ishāq Ibrahīm b. Ismāil Zāhid al-Ṣaffār al-Bukhārī is a scholar belonging to the Ḥanafī theological tradition which was improved by the contribution of Ḥanafī theologians who used thinking system of Abū Ḥanīfa (d. 150/767) as base and adopted Abū Manṣūr al-Māturīdī (d. 333/944) and his thoughts in historical process. The contents of his theological works Talkhīs al-adilla li-qawāʿid al-tawḥīd and Risāla fī al-Kalām, the method that he used, and references to his works made by Ottoman and Arab scholars indicate that he is an important Māturīdī theologian. The article focuses on his defense of the science of Kalām. -/- In Talkhīs al-adilla, there are two sections including the subject of naming, and importance and necessity of Kalām discipline. Here, the necessity of learning Kalām and its value are defended in detail. -/- Besides, rumors “Abū Ḥanīfa turned away from the science of Kalām in his doomsdays” and that “He prohibited to make occupation with Kalām completely” are evaluated. -/- When systematical vindication of the science of Kalām is examined, it is understood that al-Ṣaffār is the first theologian who reserved a private and voluminous part for defensing the Kalām among Ḥanafī Māturīdīs. Even if Abū Manṣūr al-Māturīdī, Abū al-Yusr al-Bazdawī (d. 493/1100) and Abū Muʿīn al-Nasafī (d. 508/1115) defend that the science of Kalām is not wrong for religion; yet, the vindication of Kalām does not take a place under a separate title and in a detailed manner in any of Māturīdī theologians works. -/- The method that al-Ṣaffār used when he is defending the science of Kalām, differs from strategy of Abū Ḥanīfa. While Abū Ḥanīfa has mentioned that there is a need for the science of Kalām under these new circumstances, al-Ṣaffār has defended theologians who were charged with being Ahl al-Bidaʿ, by trying to prove that the prophets especially the Prophet Ibrāhīm, even the Companions of the Prophet Muḥammad (Ṣaḥāba) and the Successors of the Companions (Tābiʿūn) scholars use their minds and make arguments in religious matters. In this respect, he emphasizes that the Qurʾān orders to think and discuss gently, not to be stay in silence: “And dispute with them, using what is best” (16.125-126). Therefore, he states that this discipline which took a mission to explain and defend the creed of Islam (ʿaqīda), cannot be characterized as an innovation (bidʿah) or illicit. -/- His vindication method can be defined as a more developed type of method that Abu’l-Ḥasan al-Ash’arī’s (d. 324/935) used in Risāla fī istiḥsān al-khawḍ fī ʿilm al-kalām. Even though he does not state its systematic, it can be understood that vindication of Kalām in al-Ṣaffār divides into three parts as of explanation, demonstration and refutation: -/- a) Explanation: Explaining the necessity and importance of the science of Kalām by giving information about its definition, names, value and place among other principles. -/- b) Demonstration: Revealing the religious basics of the science of Kalām from the Qurʾān, the Sunna of the Prophet Muḥammad, the Companions of the Prophet, and the Successors of the Companions thus specifying that it is legitimate for religion. -/- c) Refutation: Replying the claims having aim to weaken the value of Kalām principle and its religious legality. -/- Al-Ṣaffār describes ‘the science of Kalām’ as ‘Knowing the Real with the evidences which help to reach the absolute information’. By allocating the concept of 'Ḥaqq', he repeats the definition of Kalām as “it is to know God with certain evidences” in a part of his work, and “it is to know the principles of religion (uṣūl al-dīn) with certain evidences” in another part. He describes Kalām as “Knowing ḥaqq / God / uṣūl al-dīn by depending on evidence”, and tries to prove that it is wrong to consider a science which performs the stated duty, as illicit and abominable and thus turn away from it. -/- Al-Ṣaffār thinks that it is right to call this principle as ‘Kalām’ because of the certain evidences leading to the truth that this science has used. This thought was defended by other theologians as well. -/- For example, according to Saʿd al-Dīn Masʿūd al-Taftazānī (d. 792/1310) it seems like to say “This is the word (kalām), not the other knowings” by the way of the power of evidences used in Kalām.Thus, it is appropriate to give name Kalām for this science which based on certain evidences. -/- Al-Ṣaffār’s explanations revealed in scope of vindication of the Kalām are adopted by some of following scholars. Ḥusām al-Dīn al-Sighnāqī (d. 714/1314) in his book called al-Tasdīd sharḥ al-Tamhīd fī qawāʿid al-tawḥīd quotes Saffâr’s explanations as the same. -/- Al-Ṣaffār indicates that the method told in the Qurʾān is to reply questions about religion, beliefs and rejection instead of remaining in silence. The duty taken on by Kalām is this vindication activity performed by the prophets whose examples are described in the Qurʾān and which is legal and demanded. His way of thinking and vindication of the Kalām resembles that of Abū Manṣūr al-Māturīdī. Al-Māturīdī says, “Prophets and we were ordered to invite infidels to Islam. When this invitation happens, the respondents will ask for evidence and explanation, and discussion will be inevitable. Therefore, discussing and talking about subjects of Kalām is not objectionable”. -/- Thoughts of al-Māturīdī and al-Ṣaffār regarding the vindication of the Kalām were repeated by Nūr al-Dīn al-Ṣābūnī (d. 580/1184), and Fakhr al-Dīn al-Rāzī (d. 606/1210) later. According to al-Ṣābūnī, the evidences put against deniers and especially the discussion made by the Prophet Ibrāhīm to defend his own belief, prove the legality of Kalām discipline. Likewise, according to al-Rāzī, the duty of Kalām is just an activity performed already in the Qurʾān and ordered to the prophets. At this point of view, since the prophets were leading to Kalām, banning this activity is nonsense. -/- According to al-Ṣaffār, the reason for why Abu Hanifa avoids his son Hammād from these discussions is that Abu Hanifa does not like discussions based on obstinate. Otherwise, it cannot be that Abū Ḥanīfa prohibits to learn Kalām and make discussion about Kalām. According to him, this behavior of Abū Ḥanīfa results from that people discussing with him are ignorant about the subject of Kalām, discussion turns to an obstinate, and coming to an end of discussion seems impossible. This comment of al-Ṣaffār is quoted in Miftāḥ al-saʿāda wa-miṣbāḥ al-siyāda by ʿIṣām al-Dīn Aḥmed b. Muṣṭafā Tashköprüzāde (d. 968/1561) and in Minaḥ al-rawḍ al-azhar fī sharḥ al-Fiqh al-akbar by ʿAlī b. Sulṭān Muḥammad al-Qārī (d. 1014/1606) as same as his words. -/- Al-Ṣaffār’s defending the science of Kalām shows that there were opposite thoughts against Kalām in the 4th/10th and 5th/11th centuries throughout in Transoxania.In this period Aṣḥāb al-Ḥadīth and Ikhwān al-Ṣafāʾ were the opposite fronts of Kalām. In addition, he was trying to go beyond the oppositions of Ḥanafī jurists (fuqahāʾ). Because some of the Ḥanafī jurists thought that Abū Ḥanīfa forsook occupation with the science of Kalām and even he prohibited his son to have interest in this discipline. But some of Ḥanafī theologians such as al-Māturīdī, al-Nasafī and al-Ṣaffār protested this thought which describes Abū Ḥanīfa as a banner for Kalām. -/- His vindication is consistent and has scholarly depth because it is able to be against a strong opposition. -/- His book Talkhīs al-adilla li-qawāʿid al-tawḥīd is a unique source in terms of containing vindication of the Kalām in detail and also influencing the approaches of the next period scholars. This wasn't merely a man, it was the sultan Al-Malik, Al-Zâhir Rukn al-Dunia wal- Dîn Abü l-Fath Baybars whose swords were the keys to kingdoms, whose standards were like hills and the spears that rose above them were like fires whose duty it was to command men.Between 1260 and 1277, the second half of the seventh century Hegira (the thirteenth century by the Christian calendar), the Bahri Mamluk empire, founded in 1256, was governed by the sultan Baybars, the (...) fourth sovereign of his dynasty The Bahri's were former slaves from the borders of the Black Sea. They were succeeded in 1382 by the Circassian Mamluks, who were in turn supplanted in 1517 by the Ottomans. The empire comprised a vast territory including Egypt and the eastern part of present day Libya; the Near-East up to the Euphrates; rule over Nubia, Sudan and the north of Ethiopia; and sovereignty over the holy places of orthodox Islam: Mecca and Medina. The empire was threatened, from the east by the Mongols, who made inroads into Iraq and Syria on several occasions (although Egypt remained beyond their reach), and from the north by the Seljoukids of Asia Minor (Rûm). Perjumpaan Fransiskus Assisi dengan Sultan al-Kamil di tengah ko- baran perang salib akhir-akhir ini mendapat banyak perhatian dari pel- bagai macam peneliti (Hoeberichts 1997; Warren 2003, Tolan 2007, Moses 2009). Yang terakhir, Paul Moses—seorang Guru Besar Jurnalistik di Brooklyn College, New York— melakukan investigasinya sendiri dan menulis suatu buku yang sangat menarik dan aktual, seperti yang boleh diharapkan dari seorang pakar komunikasi. Landasan penting penelitian Moses adalah evaluasinya yang kritis terhadap sumber-sumber. Ia mengemukakan bahwa sumber-sumber tertua tentang peristiwa ini (...) (Jacques de Vitry, dan sebuah kronik yang anonim, keduanya saksi mata perang salib kelima itu) memberi gambaran lebih damai tentang perjumpaan ini ketimbang riwayat-riwayat hidup Fransiskus yang kemudian (Celano, Bonaventura, dll.) yang menggambarkannya sebagai misi yang konfrontatif, berusaha mempertobatkan Sultan untuk mencari kemartiran. Serangan pasukan salib ke Kesultanan Mesir dimulai dari kota pela- buhan Damietta di delta Sungai Nil. Tawaran damai Malik al-Kamil, Sultan Mesir yang dikenal bijaksana dan juga moderat terhadap umat Kristiani di Mesir, kembali ditolak oleh Kardinal Pelagius, utusan Paus dalam perang salib kelima ini. Fransiskus datang ke camp crusaders pada Agustus 1219 dan memberi peringatan kepada para crusaders bahwa serangan mereka akan gagal, tetapi ia ditertawakan. Lalu pada September 1219 ia memutuskan untuk mencari jalan lain dengan menyeberangi lini permusuhan dan mendatangi Sultan al-Malik, tidak sebagai utusan tetapi hanya dengan pengetahuan Kardinal Pelagius menggambarkan Sultan al-Kamil sebagai binatang buas. Sebagai anak zamannya, Fransiskus ingin menciptakan damai dengan mewartakan Injil kepada Sultan. Hal itu tampaknya dilakukannya dengan cara yang khas, sebab dalam sumber tertua dikatakan bahwa Sultan mendengarkannya dengan penuh perhatian, dan memperlakukan Fransiskus sebagai tamu terhormat selama beberapa hari. Menurut Moses, Sultan mungkin terharu bahwa ada orang Kristiani yang berbeda dengan para agresor rakus yang ia kenal dari perang salib. Al-Kamil yang dikenal terbuka untuk Sufisme mungkin juga suka mendengarkan Fransiskus, karena Fransiskus terkesan mirip dengan seorang Sufi. Kenyataan asli menurut Tolan ialah bahwa Fransiskus ingin menjalankan hidup rasuli sampai dengan mahkotanya, kemartiran, yang dapat ia peroleh dengan pergi mewartakan Injil kepada Sultan. Ini memang gam- baran yang jelas ada dalam biografi-biografi Celano dan Bonaventura, te- tapi tidak muncul dalam kronik-kronik lebih tua dan konteks hidup Fran- siskus sendiri. Kelemahan karya Tolan ialah bahwa ia kurang kembali kepada tulisan-tulisan Fransiskus sendiri dan riwayat hidupnya, seperti yang dilakukan secara mengesankan oleh Moses yang berhasil memper- lihatkan dalam konteks hidup Fransiskus suatu penolakan terhadap pe- rang, pewartaan damai, penghargaan terhadap praktik doa Islam, dan cara misi baru; yang semuanya harus dijadikan patokan untuk interpretasi per- jumpaan Fransiskus dengan Sultan. Tolan gagal melihat tema damai dalam riwayat hidup dan tulisan-tulisan Fransiskus itu, dan dengan demikian juga tidak mengakui adanya sesuatu yang inspiratif dalam peristiwa perjumpaan itu untuk hubungan Muslim–Kristiani masa sekarang. Sebaliknya, ia agak keras menolak interpretasi sejumlah peneliti dan gerakan damai sejak akhir abad ke-20 yang melihat misi Fransiskus sebagai misi damai dan menemukan dalam Fransiskus suatu model untuk menolak kekerasan perang dan mencari pendekatan baru, khususnya dalam hal ketegangan antaragama. Kelemahan karya Tolan ini sangat tampak justru dalam perbandingan dengan karya Moses, yang tidak mendiskusikan Tolan sebab terlambat menerimanya. Buku ketiga, St. Francis and the Conversion of the Muslims, karya Frank M. Rega, amat berbeda dengan kedua studi ilmiah di atas. Dengan tidak kritis sedikit pun, Rega menggabungkan semua yang bagus-bagus dalam pelbagai versi—dari kronik-kronik paling awal sampai ke legenda- legenda yang sangat kemudian—tentang perjumpaan Fransiskus dengan Sultan itu. Errors have been the concern of providers and consumers of health care services. However, consumers' perception of medical errors in developing countries is rarely explored. The aim of this study is to assess community members' perceptions about medical errors and to analyse the factors affecting this perception in one Middle East country, Oman.

al-Zarkashī, an ethnic Turk, is an important hadith, fiqh and commentary scholar who lived during the Mamlūks period. He was taught by some of the leading scholars of his era, such as Alā al-Dīn Mughultay (d. 762/1360), Imād al-Dīn Ibn Kashīr (d. 774/1372) ve Jamal al-Dīn al-Asnawī (d. 772/1370), and he grew up under their mentorship. Nevertheless, his only well-known student is Birmāvī (d. 831/1428). Almost half of his works have been related to fiqh and methodology of fiqh, and he (...) has also written some important works in the field of hadith. Among these, especially al-Tadhkira, al-Nukat alā Ibn al-Salāh, al-Nukat alā al-Umda fī al-Ahkām ve al-Icāba are worthy of mention. The work named al-Tadhkira, which we built our work upon, is the first known work to have been preserved in the field. Due to his being a first in his field, he was vastly studied as to how he evaluated the narrations and what kind of procedure he followed. In this work of his, not only the criticism but also the application of the text criticism adds to the importance of the work. Then, on the basis of this work, scholars such as al-Sakhāwī and al-Aclūnī made complementary works on the same subject. Summary: It is inevitable for a person to be shaped by the society he lives in. During the time when al-Zarkashī lived, Egypt was under the rule of the Mamlūks. The history of Mamlūks is examined under two periods: 1. Bahrī or Turkish Mamlūks (745 / 1344 - 794-1391) 2. Burjī or Circassian Mamlūks (784 / 1382 - 923 / 1517) period. Our author lives in both periods. About forty years of his life was in the period of Bahrī and the rest was in the period of Burjī. In both periods, the state did not have a full political authority in the country, but this was not the case in education and training. In fact, on the contrary to the political situation, scientific activities have accelerated by the arrival of many scholars to the land of Mamlūk because of the Mongol invasions coming from the east and the Crusades from the west. The increase of scientific activity was caused not only by the coming of the scholars but also by the support given by the Mamlūk sultans. In fact, they built many new madrasas in addition to the resurrection of the old ones. In addition to madrasas during the Mamlūks period, mosque, hāngāh, ribat and zāwiya are also among the educational places.Hadith, fiqh and Tafsir scholar al-Zarkashī is originally Turkish. He was born in Cairo at 745 under the conditions mentioned above. His family learned of gold and silverworking because of their subsequent settlement to Egypt, and they made their living with this craft. A person who performs this is called Zarkash in Arabic. Muhammad ibn Bahādır, who learned and did this job, was known as al-Zarkashī. al-Zarkashī, known for his love of science since childhood, was trained hadith by Alā al-Dīn Mughultay (d. 762/1360) and Imād al-Dīn Ibn Kashīr (d. 774/1372) in Damascus, and fiqh by al-Asnawī (d. 772/1370). Among his beneficiaries are distinguished personalities such as al-Subkī (d. 756/1355), al-Azraī (d. 783/1381) and al-Bulqīnī (d. 824/1421). The most remarkable of his student is al-Birmāvī (d. 831/1428).It is known that he wrote about fifty works in hadith, tafsir, fiqh, methodology of fiqh and other fields. Especially among these works al-Burhān fī ʻUlūm al-Qur’ān, al-Tadhkira, al-Ijāba, al-Bahr al-Muhīt fî Usūl al-Fiqh ve al-Mansūr fī al-Qawāid is worth mentioning. Studies on al-Burhān and al-Bahr were carried out at the level of Master and PhD.al-Zarkashī did not hesitate to criticize any person for whom he had found his mistake. For example, even though he has a great love for him, and even because of this love, he has been given the name of al-Minhāj, the criticism of al-Nawawī is the clearest indication of the value given to science. Not just him, critics of scholars such as al-Hākim al-Naysābūrī and Ibn ʻAbd al-Barr who are recognized as authority in hadith can also be considered in this framework.The work named al-Tadhkira which we have studied in our work is of importance in that it shows the accumulation of knowledge in the field of hadith. In order to compose this work, it is necessary to have enough information in this field since the riwāyas must be criticized in terms of isnād and text. To compose his work, al-Zarkashī has benefited from about a hundred and forty works related to hadith, tafsir, al-siyar, history, tabakāt, commentary, jarh - taʻdīl, ilal and maghāzī. The use of such works is an effort to reach all sources and right information as much as possible. Some of these sources are basic hadith books such as al-Bukhārī (d. 256/870) al-Sahīh, Muslim (d. 261/875) al- Sahīh, Abū Dāʾūd (d. 275/889) al-Sunan, al-Tirmidhī (d. 279/892) al-Sunan, al-Nasā’ī (d. 303/915) al-Sunan, Ibn Mādja (d. 273/887) al-Sunan, Mālik ibn Anas (d. 179/795) al-Muwatta, Ahmad ibn Hanbal (d. 241/855) al-Musnad, al-Dārimī (d. 255/869) al-Sunan, ʻAbd al-Razzāq al-Sanʻānī (d. 211/826-27) al-Musannaf, Ibn Abī Shayba (d. 235/849) al-Musannaf, Ibn Rāhwayh (d. 238/853) al-Musnad, al- Bazzār (d. 292/905) al-Musnad, Abu Yaʻlā el-Mawsilī (d. 307/919) al-Musnad, Ibn Hibbān (d. 354/965) al-Sahīh, al-Tabarānī (d. 360/971) al-Muʻjam al-Awsat and al-Muʻjam al-Kabīr, al-Hākim al-Naysābūrī (d. 405/1014) al-Mustadrak.al-Zarkashī divided the riwāyas he had studied into eight subjects. These are judgments, wisdom, zuhd, medicine, virtue, prayer, story, words and riwāyas circulating in language. He shares the information he obtains from sources about him after mentioning the riwāyas he will examine. For example, it is mentioned that there is not a hadith which is transmitted as a hadith, it is a word of a sahāba, tābiun or a person. He transferred on the riwāyas the sources mentioned in the sources, but also stated that he did not participate in some information as the place came.The author has evaluated the narrators of the riwāyas from the point of jarh and taʻdīl. He did not only evaluate riwāyas in terms of isnād, but also text criticism. This activity is a distinctive feature of his work.al-Zarkashī gave information about the misrepresentation of the name of the narrators. He also explained the strange words that are difficult to understand in the text. It is a manifestation of his knowledge in the fiqh area that some of the riwāyas that are considered weak are expressed in some sects. The author described some errors about the riwāyas. For example, he stated that a riwāya that is said to be marfūʻ is a mavkūf. al-Zarkashī also included verses, hadiths and poems about the riwāya that he had studied while writing his work or he defended it by saying that it is not the case of a riwāya that is said to be fictitious.Perhaps it is the weakest point of al-Zarkashī’s work not to give any information about some riwāya, only to mention their isnāds. He also found some riwāyas that did not have a reliable isnāds and stated that their meanings are correct. This knowledge has become an enlightening characteristic for later generations.This work has a great significance in showing that the majority of the riwāyas that spread among the people are not hadiths. As a matter of fact, 73% of the riwāyas examined in the work are weak or irrelevant riwāyas. This work of al-Zarkashī is unique. The existence of such a work has not been determined before him. This work constituted the basis of the works written by scholars such as al-Sakhāwī and al-Aclūnī in the same subject after him. (shrink)

This paper aims to assess knowledge management maturity at HEI to determine the most effecting variables on knowledge management that enhance the total performance of the organization. This study was applied on Al-Azhar University in Gaza strip, Palestine. This paper depends on Asian productivity organization model that used to assess KM maturity. Second dimension assess high performance was developed by the authors. The controlled sample was (364). Several statistical tools were used for data analysis and hypotheses testing, including reliability Correlation (...) using Cronbach’s alpha, “ANOVA”, Simple Linear Regression and Step Wise Regression. The overall findings of the current study suggest that KMM is suitable for measuring and lead to enhance high performance. KMM assessment shows that the university maturity level is in level three. Findings also support the main hypothesis and it is subhypotheses. The most important factors effecting high performance are: Processes, KM leadership, People, KM Outcomes, Knowledge Process. Furthermore the current study is unique by the virtue of its nature, scope and way of implied investigation, as it is the first study at HEI in Palestine explores the status of KMM using the Asian productivity model. Suyolcu-zāde Nahrī Aḥmad (d.1182/1768-1769) was an important sûfî poet being a member of Ismā‘īl Rūmī branch, the sect of Qādiriyya. He carried out the duty of spiritual and ethical guidance at Qādiriyya Lodge in Tekirdağ. Besides his sûfî character, he was a poet having an extensive knowledge about the theoretical and aesthetical bases of Dīwān literature. The only original copy of Nahrī’s Dīwānçe including his poems registered in the Vatican Library, Turkish Manuscripts, nr. 235. There are forty-five Turkish, twelve Arabic (...) and three Persian poems by Nahrī in this copy. The goal of this article is to present the formal and contextual features of Nahrī’s poems in Dīwānçe in the light of the analysis on some poems that we chose. Any study was not found about the poet’s life and poems in the literature review we made. In this study, poems are classified according to the verse form and the language, and the number of couplets, type of prosody, form, style and content of the chosen poems are evaluated accordingly. This study has importance in terms of providing insight about the Religious-Sûfîstic belief in the region and period of Nahrī Aḥmad who was a sûfî poet and a member of Qādiriyya sect. In addition, the study gives information about many important influencers of the period, particularly Niyāzī-i Miṣrī and inform the readers about these influencers’ and sûfîs’ effects on Nahrī’s poems and ideas. The study also makes contribution to determining literary-sûfistic terminology of 18th century.Summary: Suyolcu-zâde Nahrī Aḥmad (d.1182/1768-1769) was a member of Qādiriyya Dervish Convent in Tekirdag where he was born. He became the head sheikh of this convent following his father Sheikh Muḥammad Efendi and worked for the convent in several ways. Nahrī Aḥmad moved back to his hometown in 1182/1768-1769 after completing his Hajj duty and died soon after that. Nahrī had two works according to Osmanlı Müellifleri (Ottoman Authors) and it is stated that the first one of these two works is about “unity of existence”. It should be mentioned that we haven’t found a copy of this work yet. The other work of Nahrī is his Dīwānçe, which includes his poems. The only copy of this significant work is registered in Vatican Library, Turkish Manuscripts, nr. 235. In this study, we had the chance to determine a third work of Nahrī which has never been mentioned in the related literature. This third work that we determined is based on the information in an Arabic poem on the page 21a of the poet’s Dīwānçe. This book that we determined is an interpretation book completed in 1166/1752-53 but Nahrī Aḥmad didn’t mention the name of the work. Nahrī Aḥmad was a spiritual guide and sufi, and he was assigned to the duty of showing the true path in dervish lodge following his madrassa education, learning Qādiriyya lodge’s morals and methods and completing his “spiritual journey”. Besides these, he was a significant poet who could write poems in Arabic, Persian and Turkish languages and he was literary competent who knew the theoretical and aesthetic rules of Dīwān literature and used these features professionally in his works. When Nahrī’s poems are analyzed, it can be seen that he adopted the understanding of existence, knowledge and belief based on Islamic Sufism. Besides, it can be seen that he internalized the significant Religious-Sufi Turkish literature figures including especially Yūnus Emre.In the copy of his Dīwānçe, registered in Vatican Library, there are forty-five Turkish, twelve Arabic and three Persian poems. There are two other poems that weren’t written by Nahrī in the same work. These poems were written by a poet with penname of ‘Ᾱrif in the period when Nahrī’s son Muḥammad Muṣlih al-Dīn was the head sheikh in the same Dervish convent. These historical poems are significant as they describe the re-building of ruined Tekirdag Qādiriyya convent after Nahrī’s period. The goal of this article is to present the formal and contextual features of poems in Nahrī’s Dīwānçe on the basis of chosen poems. As far as we could determine, there is no other study on Nahrī’s works. Nahrī’s Dīwānçe wasn’t a kind of rearranged work of collected poems. Therefore, we classified the poems in terms of the form and language and evaluated the number of couplets, aruz prosody, shape, type and content. Poems of Nahrī in Dīwānçe in terms of verse style are: Four Turkish, three Arabic, one Persian ode, one Turkish compounded stanza, seventeen Turkish, nine Arabic and one Persian major stanza, three Turkish five-line stanzas, two Turkish pentastichs, eighteen Turkish and one Persian lyric.Nahrī Aḥmad wrote five-line stanzas for three of Niyāzī-i Miṣrī’s lyrics and one of Bāqī’s lyrics. He wrote parallel poems about one pentastich, one lyric and one other poem written in a specific style of blank verse of Niyāzī-i Miṣrī. Besides, there is also an original poem that is quite unique in the work. Nahrī wrote five couplets before each verse in Niyāzī-i Miṣrī’s ode which resulted in the creation of a common ode. Poems in Dīwānçe are contextually religious-Sufi based. ‘Abd al-Qādir al-Jīlānī, Ismā‘īl Rūmī who was the founder of the order of Rūmiyya branch and other sheikhs of Qādiriyya dervish order are the main names mentioned in the poems. One other significant point in Nahrī’s poems is that he had a deep love and respect for Niyāzī-i Miṣrī. There are praises, quintets and parallel poems about Miṣrī in Dīwānçe which shows Niyāzī-i Miṣrī’s effect on his work. This effect is so great that it covered not only the content but also there are the signs of the effect in terms of metaphoric language, words and verses. It can be said that ‘Abd al-Qādir al-Jīlānī and Niyāzī-i Miṣrī, a member of Khalwatī order, were two significant names that surrounded the mental world of Nahrī, located in the texture of his poems and gave characteristic features to his works. There is a great number of historical poems in Nahrī’s Dīwānçe. He wrote twenty-six historical verses about various historical issues such as birth and death, construction of mosque, dervish monastery, zawiya, pavilion, repairing of mansion, renovation of dervish convent, enthronement of Sultan and appointment of Grand Vizier. Also, there are some other important parts in Nahrī’s Dīwānçe such as invocation, praise and self-adulation.Although there are not many poems in the previously mentioned copy in Vatican Library, there are various names mentioned in these poems. When these poems are analyzed, it can be seen that there are the names of some prophets, some companions of Prophet Muḥammad such as ‘Alī, Ja‘far al-Sādiq, some Persian legendary characters such as Afrāsiyāb, Rustem and Anūshirwān, some Sufi names such as Manṣūr al-Hallaj, Jalāl al-Dīn Rūmī, Shams al-Dīn of Tabrīz, Ḥācī Bektash Velī, Ibn al-‘Arabī and Bāyazīd al-Bisṭāmī, philosopher Galen and famous love heroes Laylā and Majnūn. That is to say, the poet has a rich world of references. On the other hand, there are the names of some works mentioned in Dīwānçe. Epistle of Niyāzī-i Miṣrī named Devre-i ‘Arshiyya, and Ibn al-‘Arabī’s al-Futūhāt al-Makkiyya are the other names mentioned in the work. Name of the places included in Nahrī’s poems are: Aden, Aqmescit, Baghdad, Baghcesaray, Baṭḥā, Balkh, Dimashq, Ḥijāz, Iraq, Iran, Cairo, Ken‘ān, Karbalā, Qılburun, Crimea, Kirmān, Egypt, Nemce, Rūm, Sanaa, Shām, Yemen. This study has importance in terms of providing insight about the religious-sûfî belief in the region and period of Nahrī Aḥmad who was a sûfî poet and a member of Qādiriyya sect. In addition, the study gives information about many important influencers of the period, particularly Niyāzī-i Miṣrī. Moreover, it informs the readers about these influencers’ and sûfîs’ effects on Nahrī’s poems and ideas. This paper studies the dynamic characteristics of triopoly models that are constructed based on a 3-dimensional Cobb–Douglas utility function. The paper presents two parts. The first part introduces a competition among three rational firms on which their prices are isoelastic functions. The competition is described by a 3-dimensional discrete dynamical system. We examine the impact of rationality on the system’s steady state point. Studying the stability/instability of this point, which is Nash equilibrium and is unique in those models, is illustrated. (...) Numerically, we give some global analysis of Nash point and its stability. The second part deals with heterogeneous scenarios. It consists of two different models. In the first model, we assume that one competitor adopts the local monopolistic approximation mechanism while the other opponents are rational. The second model assumes two heterogeneous players with LMA mechanism against one rational firm. Studies show that the stability of NE point of those models is not guaranteed. Furthermore, simulation shows that when firms behave rational with symmetric costs, the stability of NE point is achievable. (shrink)

This paper aims to identify computerized management information systems resources and their relationship to the development of performance in the Electricity Distribution Company in Gaza. This research used two dimensions. The first dimension is computerized management information systems and the second dimension the Development of Performance. The control sample was (063). (360) questioners were distributed and (306) were retrieved back with a percentage of (85%). Several statistical tools were used for data analysis and hypotheses testing, including reliability correlation using Cronbach’s (...) alpha, “ANOVA”, Simple Linear Regression and Step Wise Regression. The overall findings of the current study suggested the presence of a statistically significant relationship between resources (physical, software, and human and organizational) for the computerized management information systems and the development of performance in the Electricity Distribution Company in Gaza. The study recommended the following: The need to strengthen the company's management interest in the potential of computerized management information systems and using them in the computerization of all the company's activities. And the need to involve workers and users in the design of computerized management information systems and assessment and development process. And strengthen the relationship between users and information systems personnel in the department responsible for the system. And it is essential that the company is developing the infrastructure for information technology in general, and computerized management information systems, in particular for the development of performance. And increase interest in providing resources (physical, software, and human and organizational) for the computerized management information systems. The research aims to identify the trends of Palestinian higher educational institutions in Gaza Strip as learning organizations from the perspective of senior management in the Palestinian universities in Gaza Strip. The researchers used descriptive analytical approach and used the questionnaire as a tool for information gathering. The questionnaires were distributed to senior management in the Palestinian universities. The study population reached (344) employees in senior management is dispersed over (3) Palestinian universities. A stratified random sample of (182) employees from (...) the Palestinian universities was selected and the recovery rate was (69.2%). Statistical analysis (SPSS) program was used for analysis and processing the data. The study found the following results: There is an agreement about: the importance of the focus of "organizational structure" with an average approval, the importance of "technological infrastructure" axis with high approval, and the importance of "strategic" with an average approval. The results concluded that the study sample agree on the importance of "organizational dimension" highly. The results showed that the sample believe that the "strategic leadership" level in the universities got medium-approval. There is a fair level agreement about the axis of interest "teams / committees". There is an agreement about the importance of the "human dimension" moderately. The results showed that the sample is highly agreed about the importance of focus of the "knowledge management", and the focus of the "continuing education". They agreed weakly to somewhat about the importance of the focus of "scientific research", moderately agree about the importance of the center of "institutional culture", agree moderately on the importance of "cognitive dimension". The results showed that the sample largely agree on the importance of the focus of "strategic partnerships and alliances". They agree highly on the axis "keep up with the labor market" and on the focus of the importance of "technology incubators". The results showed that the sample moderately agree about the importance of the theme on "consulting and training", the importance of the focus of "social responsibility", and the focus of the "Community dimension". The study found a group of recommendations including: there is a need to provide suitable environment that achieve learning organizations. There is a need to develop the technological infrastructure (hardware, software, networks, databases, and human skills) because of the great advantages that they offer. The universities need to adopt knowledge management in the academic and administrative departments because knowledge is the core of the work of these departments. The establishment of technology incubators in universities to adopt outstanding university research projects, to protect, to supports, and to market them; furthermore, to develop the capabilities and skills of employees in the field of information technology. Substituted judgment assumes adequate knowledge of patient’s mind-set. However, surrogates’ prediction of individual healthcare decisions is often inadequate and may be based on shared background rather than patient-specific knowledge. It is not known whether surrogate’s prediction of patient’s integrative life-story narrative is better. Respondents in 90 family pairs rank-ordered 47 end-of-life statements as life-story narrative measure and completed instruments on decision-control preference and healthcare-outcomes acceptability as control measures, from respondent’s view and predicted pair’s view. They also scored their confidence in (...) surrogate’s decision-making and familiarity with pair’s healthcare-preferences. Life-story narratives’ prediction was examined by calculating correlation of statements’ ranking scores between respondent-personal and respondent-surrogate Q-sorts and between respondent-surrogate and pair-personal Q-sorts before and after controlling for correlation with respondent-personal scores, and by comparing percentages of respondent-surrogate Q-sorts co-loading with pair-personal vs. respondent-personal Q-sorts. Accuracy in predicting decision-control preference and healthcare-outcomes acceptability was determined by percent concordance. Results were compared among subgroups defined by intra-pair relationship, surrogate’s decision-making confidence, and healthcare-preferences familiarity. Mean age was 35.4 years, 69% were females, and 73 and 80% reported ≥ very good health and life-quality, respectively. Mean surrogate’s decision-making confidence score was 3.35 and 75% were ≥ familiar with pair’s healthcare-preferences. Mean projection, simulation, and adjusted-simulation correlations were 0.68, 0.42, and 0.26, respectively. Out of 180 respondent-surrogate Q-sorts, 24, 9, and 32% co-loaded with respondent-personal, pair-personal, or both Q-sorts, respectively. Accuracy in predicting decision-control preference and healthcare-outcomes acceptability was 47 and 52%, respectively. Surrogate’s decision-making confidence score correlated with adjusted-simulation’s correlation score. There were significant differences among the husband-wife, parent-child, and sibling-sibling subgroups in percentage of respondent-surrogate Q-sorts co-loading with pair-personal Q-sorts and percent agreement on healthcare-outcomes acceptability. Despite high self-reported surrogate’s decision-making confidence and healthcare-preferences familiarity, family surrogates are variably inadequate in simulating life-story narratives. Simulation accuracy may not follow the next-of-kin concept and is 38% based on shared background. (shrink)

BackgroundA different ethos with respect to the perception of medical ethics prevails in societies in transition such as those in the Arabian Peninsula, which makes it difficult to apply international principles of bioethics in medical practice. This study aimed to develop and psychometrically test an instrument that measures physicians’ awareness of bioethics and medical law and their attitudes towards the practice of medical ethics. Additionally, it examined physician correlates influencing the awareness of bioethics.MethodsFollowing a rigorous review of relevant literature by (...) a panel of experts, a 13-item instrument, the Omani physicians’ bioethics and medical law awareness (OBMLA) questionnaire was developed with the aim of assessing physicians’ awareness of bioethics and medical law. The study tool’s construct validity and internal consistency reliability were examined by exploratory factor analysis (EFA) and Cronbach’s alpha. In a cross-sectional study, the questionnaire was distributed among a random sample of 200 physicians at a tertiary hospital in Muscat, Oman. Participant characteristics that may influence awareness of bioethics and medical law were explored.ResultsThe EFA of the OBMLA questionnaire resulted in three well-loading factors: (1) Physicians’ bioethics practice subscale (2) incentive related bioethics subscale and (3) medical law awareness subscale. Internal consistency reliability ranged between Cronbach’s α: 0.73–0.8. Of the total 200 participants, 52% reported that teaching medical ethics during medical school was inadequate. The overall mean (standard deviation, SD) of the bioethics awareness score and Omani medical law awareness were 27.6 (3.5) and 10.1 (2.1) respectively. The majority of physicians (73%) reported that they frequently encountered ethical dilemmas in their practice and 24.5% endorsed the view that unethical decisions tended to occur in their practice.ConclusionThe study provides an insight into the practice of bioethics, and the awareness of bioethics and medical law among physicians in a teaching hospital in Oman. The OBMLA questionnaire appears to be a valid and reliable tool to assess a physician’s awareness of bioethics and medical law. In this preliminary study, it appears that participants have suboptimal scores on the indices which measure practice and awareness of bioethics and medical law. (shrink)

The Fatwā-house, which was within the body of Meshihat in the Ottoman Empire, gave answers to the questions posed to it by focusing on the Hanafi sect and the preferred fatwās of this sect for centuries. These questions and answers were also duly recorded. In this study, based on The Record for the Legal Responses of the Supreme Fatwā Office, which is registered at records numbered 378 in the Meshihat Archive of the Istanbul Mufti, one of the records containing the (...) answers given by the institution. It is an attempt to create an imagination about the scope and sphere of influence of the fatwā activity in the last period of the Ottoman Empire. Accordingly, in the last thirteen years of the state, Fatwā-house has been the addressee of questions from individuals, state and private institution directors, societies, ministries and the Grand Vizier. While some of these questions came from the provinces within the Ottoman borders or from the countries that had an administrative ties with the Ottoman Empire, some of them were submitted to the Fatwā-house by the Muslims of other states from the lost lands or simply because the caliphate center was the official fatwā organ. At the records, there is also a record of the questions coming from muslims who are Ottoman citizens but residing in other countries. Looking at the subjects, it was determined that most of the questions were asked about foundations. In addition, the permissibility of obtaining interest by bank facility or depositing money in the bank, the establishment of modern schools and whether the ways to create resources for these schools are permissible, whether teaching in Latin letters is possible, the provision of life insurance, the importance of cleanliness in the fight against cholera, the fight against innovations (bidʻas) in mosques. It is seen that questions on different issues, from issues such as whether the wife of the lost (mafqud) can be separated by the judge or not; to the issues of whether the fulfillment of judgment can be regarded as the end of the judgment or not. As it is mentioned in some fatwā records at the record book, it is obligatory to decide on fatwā and its fulfillment in the Ottoman Empire with the most authentic and preferred view of the Hanafi sect. The last two fatwā questions mentioned above are handled as examples of giving up the act with the will of the head of state, with the preferred fatwâs discussed in this article. It is only possible with the will of the head of state to make a decision with an opinion other than preferred fatwâ or an other opinion out of the sect. According to the first example, some of those of the citizens of other states outside the Ottoman Empire came to the Ottoman lands for reasons like trade etc. and married to Muslim women there and then left them suffering. This was also true for the wives of men who went to wars and did not return. Although the drawbacks of the Hanafi sect's preferred view, that one should wait until the age of ninety, one hundred, one hundred and twenty, or until the death of their peers, were resolved by appointing a regent from other sects, continuity could not be ensured in this practice either, finding people has not always been possible. For this reason, in the time of Shaykh al-Islam Hayri Efendi, a statement of change was prepared and submitted to the will of the sultan. In the issue of whether the signature of the head of state can be counted as the end of the judgment, another subject in which the will of the head of state is applied, the stages of abandoning the preferred view can be followed much more clearly. In the case of the dismissal of the judge or the expiration of the term of office before the execution of the judgment, especially in the distant provinces of the state, in the case of the judge's dismissal or the expiration of his term, according to the preferred view of the sect, which was based on juristic discretion, the closure of the cases took many years. It is seen that the judgment reached by analogy was submitted to the will of the sultan, with an article added to the script regarding the prepared procedure of reasoning, although there is no preferred view since it is the most suitable opinion for the interests of the people and the necessities of the century due to the increase in complaints. Effective from the time it was approved by the head of state, the execution of the sentence is no longer a requirement for the trial to be completed. The changes in the provisions of these matters also show that, although it was important for the Ottoman State to comply with the preferred view of the Hanafi sect - as in the previous Shaykh al-Islams' fatwās in the form of ma'ruzat - it was considered more necessary to look after the interests of the Muslims and different opinions were enacted and put into practice. This paper aims to identify computerized management information systems resources and their relationship to the development of performance in the Electricity Distribution Company in Gaza. This research used two dimensions. The first dimension is computerized management information systems and the second dimension the Development of Performance. The control sample was (063). (360) questioners were distributed and (306) were retrieved back with a percentage of (85%). Several statistical tools were used for data analysis and hypotheses testing, including reliability correlation using Cronbach’s (...) alpha, “ANOVA”, Simple Linear Regression and Step Wise Regression. The overall findings of the current study suggested the presence of a statistically significant relationship between resources (physical, software, and human and organizational) for the computerized management information systems and the development of performance in the Electricity Distribution Company in Gaza. The study recommended the following: The need to strengthen the company's management interest in the potential of computerized management information systems and using them in the computerization of all the company's activities. And the need to involve workers and users in the design of computerized management information systems and assessment and development process. And strengthen the relationship between users and information systems personnel in the department responsible for the system. And it is essential that the company is developing the infrastructure for information technology in general, and computerized management information systems, in particular for the development of performance. And increase interest in providing resources (physical, software, and human and organizational) for the computerized management information systems. The current study is unique by the virtue of its nature, scope and way of implied investigation, as it is the first study at Electricity Distribution Company in Gaza resources explores the status of Computerized management information systems and their relationship to the development of performance in the Electricity Distribution Company in Gaza increasing interest in Computerized management information systems through continuity, keeping pace with technological means and modern techniques. The paper assesses Knowledge Management Maturity(KMM) in the universities to determine the impact of knowledge management on performance excellence. This study was applied on Al-Azhar University and Al-Quds Open University in Gaza strip, Palestine. This paper depends on Asian productivity organization model that used to assess KMM. Second dimension which assess performance excellence was developed by the authors. The controlled sample was (610). Several statistical tools were used for data analysis and hypotheses testing, including reliability Correlation using Cronbach’s alpha, “ANOVA”, (...) Simple Linear Regression and Step Wise Regression. The overall findings of the current study suggest that KMM is suitable for measuring performance excellence. KMM assessment shows that both universities maturity level is in level three. Findings also support the main hypothesis and it is sub- hypotheses. The most important factors effecting performance excellence are: Processes, KM leadership, People, KM Outcomes. Furthermore the current study is unique by the virtue of its nature, scope and way of implied investigation, as it is the first comparative study in the universities of Palestine explores the status of KMM using the Asian productivity Model. The research aims to identify the impact of the management requirements on operating of computerized management information systems to improve performance, and discuss the perceptions of respondents to develop the performance of employees in the Gaza Electricity Distribution Company, the researchers used the stratified sample method, (360) questionnaires were distributed on the study sample, (306) questionnaires were recovered with a percentage of (85%). The most important findings of the study: computerized MI have a positive impact on the development of performance (...) in the Gaza Electricity Distribution Company systems. The is statistical significance impact between “the physical, software supplies, human and organizational” requirements for the management and operation of computerized management information systems and performance development in the Gaza Electricity Distribution Company. The research also concluded a series of recommendations: the need to strengthen the company's management interest in the use of computerized management information systems in all its components and elements of being an important variable which contributes to the effect on performance development. It's essential that we develop the infrastructure for information technology in general, and computerized management information systems, in particular for the development of performance. Increased interest in providing the material of equipment and devices used in the computerized management information system requirements. Interest in providing technical inputs to the computerized management information systems through keeping pace with technological means and modern techniques and work on the training of personnel to use those systems. This study was applied on three intermediate colleges in Gaza strip, Palestine. Asian productivity organization model was applied to measure KMM. Second dimension which assess high performance was developed by the authors. The controlled sample was 190. Several statistical tools were used for data analysis and hypotheses testing, including reliability correlation using Cronbach’s alpha, “ANOVA”, (...) simple linear regression and step wise regression and LSD test. The overall findings of the current study show that maturity level is in the second level. Findings also support the main hypothesis and its sub- hypotheses. The most important factors effecting high performance are the processes, KM leadership, people and KM outcomes. In addition, there are differences in high performance for college (PTC). Furthermore, the current study is unique by the virtue of its nature, scope and way of implied investigation, as it is the first comparative study between intermediate colleges in Palestine that explores the status of KMM using the Asian productivity model. Objectives: to assess physicians’ and patients’ views in Saudi Arabia towards involving the patient versus the family in the process of diagnosis disclosure and decision-making, and to compare them with views from the USA and Japan.Design: A self-completion questionnaire was translated to Arabic and validated.Participants: Physicians from different specialties and ranks and patients in a hospital or attending outpatient clinics from 6 different regions in KSA.Results: In the case of a patient with incurable cancer, 67% of doctors and 51% of (...) patients indicated that they would inform the patient in preference to the family of the diagnosis . Assuming the family already knew, 56% of doctors and 49% of patients would tell the patient even if family objected . However, in the case of HIV infection, 59% of physicians and 81% of patients would inform the family about HIV status without the patient’s consent . With regards to withholding ventilatory support, about 50% of doctors and over 60% of patients supported the use of mechanical ventilation in a patient with advanced cancer, regardless of the wishes of the patient or the family. Finally, the majority of doctors and patients were against assisted suicide.Conclusions: Although there was more recognition for a patient’s autonomy amongst physicians, most patients preferred a family centred model of care. Views towards information disclosure were midway between those of the USA and Japan. Distinctively, however, decisions regarding life prolonging therapy and assisted suicide were not influenced to a great extent by wishes of the patient or family, but more likely by religious beliefs. The study investigates the effect of board characteristics and firm performance on disclosure tones by considering DICTION five master variables namely activity, optimism, certainty, realism and commonality tones using a sample of 779 annual reports of GCC listed firms (2012 to 2018). Disclosure tones of the sampled GCC firms were measured through corporate narrative disclosures by DICTION 7.0 software. Then, the ordinary least square regression analysis was conducted. The main findings of the study show that firm performance has a significant (...) effect on disclosure tones in terms of activity, optimism, certainty, and realism tones except for commonality reported tone. Board characteristics have different effects on the five disclosure tones. The study offers a unique contribution to accounting literature as it is one of the first studies in the Gulf region that seeks to examine the relationship between disclosure tones and firm performance as well as board governance.
